Welcome to e.terra kitchen (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website (eterrakitchen.com) and our commercial kitchen and workspace rental services (“Services”). By accessing or using our website or Services, you agree to be bound by these Terms. If you do not agree, please do not use our website or Services.

1. Acceptance of Terms

By using our website or Services you affirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to agree to these Terms. These Terms, together with our Privacy Policy, form the entire agreement between you and e.terra kitchen.

2. Description of Services

• Hourly, daily, and monthly kitchen rentals
• Dry, refrigerated, and freezer storage
• Photo/video “test kitchen” spaces
• Staffing, equipment rental, and logistics coordination (optional add-ons)

3. User Registration & Account Security

• Registration: You must create an account and provide accurate information.
• Account Security: You are responsible for safeguarding your credentials and all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized use.

4. Fees, Billing & Payments

All rates are displayed on our site and confirmed at booking. You agree to pay all charges via the payment method on file. Fees are non-refundable except as stated. Late payments may incur interest.

5. Booking, Cancellation & No-Show Policies

• Booking Confirmation: Reservation is confirmed once payment is processed.
• Cancellations:
  • ≥48 hrs before: full refund
  • <48 hrs before: 50% fee
  • No-shows: 100% charge
• Rescheduling: Subject to availability; fees may apply.

6. User Conduct & Use of Facilities

You must comply with all health and safety regulations. Only food-safe activities are permitted. You are responsible for cleaning and any damage beyond normal use.

7. Intellectual Property

All site content is owned by e.terra kitchen or its licensors and protected by law. You may not reproduce or distribute without permission.

8. Disclaimers

Our Services are provided “as is” and “as available.” We disclaim all warranties. We do not guarantee specific outcomes.

9. Limitation of Liability

e.terra kitchen will not be liable for indirect, incidental, or consequential damages. Our maximum liability is limited to the fees you paid for the Service in question.

10. Indemnification

You agree to indemnify and hold harmless e.terra kitchen and its affiliates from any claims arising out of your use of our Services or violation of these Terms.

11. Termination

We may suspend or terminate your access at any time for violations. Upon termination, your rights under these Terms cease immediately.

12. Governing Law & Dispute Resolution

These Terms are governed by New York law. Disputes will be resolved in New York County courts.
